Processing Options

Six money-saving, time-saving, tension-reducing processing options the New Jersey legal establishment would rather you didn't know.

  1. If you submit documentation that you can't afford the filing fee and other court expenses, the court probably will waive all its fees, saving you at least $250.  [R. 1:13-2]
  2. If no filed court documents ask a judge to resolve child-related issues such as custody or support, the court can't collect an extra fee for a parenting class and make the parties attend one.  [N.J.S.A. 2A:34-12.2]
  3. If a spouse signs an Acknowledgment of Service, no sheriff or process server is needed.  [R. 1:5-3]
  4. If the party seeking the divorce has first-hand knowledge that the spouse is a civilian and so certifies in a sworn document, the military won't have to provide service records.  [R. 1:5-7]
  5. If child-related and financial issues remain uncontested, neither party needs to submit specific insurance information that, once filed, becomes public record.  [R. 5:4-2(f)]
  6. If child-related and financial issues remain uncontested, neither party needs to file a "Confidential Litigant Information Sheet" and divulge personal data that could become public record.  [R. 5:4-2(g)]
